Terms of Use

These Terms of Use ("Terms") govern your access to and use of visafetch.com and any related services, features, and content (collectively, the "Services") provided by VisaFetch ("VisaFetch," "we," "us," or "our").
Please read these Terms carefully. They contain important provisions about your rights and obligations, including disclaimers of warranties, limitations of liability, and a binding arbitration clause and class-action waiver (Section 16).
By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. About the Services
What VisaFetch is not:
VisaFetch does not book, hold, or reserve appointments on your behalf.
VisaFetch is not a law firm, immigration consultancy, or relocation agency, and we do not provide legal advice.
VisaFetch is not affiliated with, endorsed by, or sponsored by VFS Global, the Government of Portugal, the Portuguese Consulate, or any government agency.
VisaFetch does not guarantee that an appointment will become available, that you will be able to book one, or that your visa application will be approved.
2. Eligibility
To use the Services, you must:
Be at least 18 years old (or the age of majority in your jurisdiction).
Have the legal capacity to enter into a binding contract.
Not be barred from using the Services under applicable law.
By using the Services, you represent and warrant that you meet these requirements.
3. Accounts
To access most features, you must create an account. You agree to:
Provide accurate, current, and complete information during registration.
Keep your login credentials confidential.
Promptly update your information if it changes.
Be responsible for all activity that occurs under your account.
Notify us immediately of any unauthorized access or security breach.
You may not share your account, sell access to it, or allow another person to use it. We may suspend or terminate accounts that violate these Terms.
4.1 Free and Paid Plans
Some features of the Services are available at no charge. Other features may require a paid subscription. Pricing, billing frequency, and feature inclusions are described at sign-up or on our pricing page.
4.2 Billing
If you subscribe to a paid plan, you authorize us (and our payment processor) to charge the payment method on file for all applicable fees, taxes, and recurring charges. Subscriptions automatically renew at the end of each billing period unless cancelled before renewal.
4.3 Cancellation
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to paid features until that date.
4.4 Refunds
Except where required by applicable law, all fees are non-refundable. We do not provide refunds for partial billing periods, unused features, or missed appointment opportunities.
4.5 Changes to Pricing
We may change our prices or fee structures. We will provide reasonable advance notice of changes affecting active subscriptions. If you do not agree to the new pricing, you may cancel before the change takes effect.
5. Acceptable Use
You agree not to:
Use the Services for any unlawful, fraudulent, or harmful purpose.
Attempt to gain unauthorized access to the Services, other accounts, or our systems.
Interfere with, disrupt, or place undue load on the Services or related infrastructure.
Reverse engineer, decompile, or attempt to derive the source code of the Services, except as expressly permitted by law.
Scrape, crawl, copy, or systematically extract content or data from the Services.
Resell, sublicense, or redistribute access to the Services without our written permission.
Use the Services to harass, defame, or harm any other person.
Submit false, misleading, or impersonating information.
Circumvent any access controls, rate limits, or security features.
Use automated tools (other than those we provide) to access or interact with the Services.
We may investigate and take appropriate action against any suspected violation, including suspending or terminating your account.
6. Service Availability and Limitations
6.1 No Guarantee of Availability
The Services rely on the continued operation and accessibility of third-party websites (notably VFS Global). We do not control those sites and cannot guarantee that they will be available, accurate, or unchanged. VFS Global may modify its site, alter its appointment process, block automated checks, or take its system offline at any time.
6.2 No Guarantee of Appointments
Appointment availability is set by VFS Global and the Portuguese consular network and is outside our control. We do not guarantee that:
An appointment slot will become available.
You will receive an alert before all available slots are taken.
You will be able to successfully book an appointment after receiving an alert.
Alerts will be delivered without delay or interruption.
You acknowledge that appointment slots can disappear within seconds and that successfully booking an appointment depends on factors beyond our control, including your own response time, network conditions, and competition from other applicants.
6.3 Maintenance and Modifications
We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.
6.4 Beta Features
We may offer features identified as "beta," "preview," or similar. These features are provided as-is, may be unstable, and may be changed or removed without notice.
7. Informational Content; No Legal Advice
The checklists, booking tips, articles, and other informational content provided through the Services are for general informational purposes only. They are not legal advice and do not create an attorney-client relationship between you and VisaFetch, our employees, or any attorney who has reviewed our content.
Visa requirements change frequently and depend on your individual circumstances. You are responsible for verifying current requirements with official sources (such as the Portuguese Consulate or VFS Global) and, where appropriate, consulting with a qualified immigration attorney.
8. Third-Party Services and Links
The Services may interact with or link to third-party websites and services, including VFS Global. We do not control these third parties and are not responsible for their content, accuracy, availability, terms, or privacy practices. Your use of any third-party site or service is at your own risk and subject to that party's terms.
9. Intellectual Property
9.1 Our Content
The Services, including all software, text, graphics, logos, design, content, and other materials we provide (excluding User Content), are owned by or licensed to VisaFetch and are protected by copyright, trademark, and other intellectual property laws.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. No other rights are granted.
9.2 Trademarks
"VisaFetch," and our logos are trademarks of First Gate Priority. You may not use them without our prior written permission. All other trademarks are the property of their respective owners.
9.3 Feedback
If you submit feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them for any purpose without obligation to you.
10. User Content
You may submit information, messages, screenshots, or other materials in connection with your use of the Services ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, process, and use that content as needed to operate, secure, and improve the Services.
You are solely responsible for your User Content and represent that you have all necessary rights to submit it and that it does not violate any law or third-party right.
11. Privacy
Your use of the Services is also governed by our Privacy Policy, which describes how we collect, use, and share information.
12. Termination
You may terminate your account at any time by cancelling through your account settings or by contacting us.
We may suspend or terminate your access to the Services, with or without notice, if we believe you have violated these Terms, created risk or legal exposure for VisaFetch, or for any other reason at our discretion. Upon termination:
Your right to use the Services ends immediately.
We may delete your account and associated data, subject to our Privacy Policy and applicable law.
Sections of these Terms that by their nature should survive termination will survive (including Sections 9, 13, 14, 15, 16, and 17).
13. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, VISAFETCH DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
The Services will detect every appointment slot, or detect them in time for you to book.
Alerts will be delivered without delay, error, or omission.
The Services will be available at any particular time or location.
Information provided through the Services (including checklists and booking tips) is accurate, complete, or current.
The Services will be free from viruses, security defects, or other harmful components.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the above exclusions may not apply to you.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
IN NO EVENT WILL VISAFETCH, FIRST GATE PRIORITY, OR THEIR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR DAMAGES ARISING FROM: MISSED APPOINTMENT SLOTS; DELAYED OR FAILED ALERTS; CHANGES TO THE VFS GLOBAL WEBSITE OR APPOINTMENT PROCESS; INABILITY TO TRAVEL; LOST DEPOSITS, RENT, OR RELOCATION COSTS; VISA DENIAL OR DELAY; OR RELIANCE ON ANY INFORMATION PROVIDED THROUGH THE SERVICES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD $100.
THESE LIMITATIONS APPLY REGARDLESS OF THE LEGAL THEORY ON WHICH A CLAIM IS BASED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, AND IN THOSE JURISDICTIONS OUR LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
15. Indemnification
You agree to defend, indemnify, and hold harmless VisaFetch, First Gate Priority, and their officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) your User Content.
16. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects how disputes between you and VisaFetch are resolved.
16.1 Informal Resolution
Before initiating any formal dispute, you agree to contact us at the address in Section 19 and attempt to resolve the dispute informally for at least 30 days.
16.2 Binding Arbitration
If informal resolution fails, any dispute, claim, or controversy arising out of or related to the Services or these Terms will be resolved by binding individual arbitration administered by a recognized arbitration provider (such as the American Arbitration Association) under its applicable consumer rules. Arbitration will take place in the United States, and judgment on the award may be entered in any court of competent jurisdiction.
16.3 Class Action Waiver
You and VisaFetch agree that disputes will be resolved only on an individual basis, not as part of a class, collective, or representative action. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
16.4 Exceptions
This Section does not prevent either party from: (a) seeking injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights or stop unauthorized access; or (b) bringing an individual action in small claims court.
16.5 Opt-Out
You may opt out of this arbitration agreement by sending written notice to us at the address in Section 19 within 30 days of first accepting these Terms. The notice must include your name, account email, and a clear statement that you are opting out.
17. Governing Law
These Terms are governed by the laws of the State of [insert state], United States, without regard to its conflict of laws rules. Subject to Section 16, any action not subject to arbitration will be brought exclusively in the state or federal courts located in [insert county/state], and you consent to personal jurisdiction and venue there. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
18. Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or through the Services and update the "Last Updated" date above. Changes take effect on the date posted unless otherwise stated. Your continued use of the Services after changes take effect means you accept the updated Terms. If you do not agree, stop using the Services and cancel your account.
19. Miscellaneous
Entire Agreement. These Terms and the Privacy Policy are the entire agreement between you and VisaFetch regarding the Services and supersede any prior agreements.
Severability. If any provision is found unenforceable, the remaining provisions will remain in full effect.
No Waiver. Our failure to enforce a provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
Notices. We may give notice through the Services or by email. You may give notice to us at the contact information below.
